1. About these Terms

These Website Terms of Use (“Terms”) explain the conditions that apply when you access or use the website https://byharadau.com (“Website”).

By using the Website, you agree to these Terms. If you do not agree with them, you should stop using the Website.

These Terms relate only to the use of the Website. They do not constitute a Managed Website Services Agreement or any other contract for the provision of services.

ByHaradau is a trading name operated by Daniel Haradau, a sole trader established in England and Wales.

ByHaradau provides managed website systems, digital infrastructure, design, hosting, protection, continuous improvement and related digital services for businesses and professionals.

3. Purpose of the Website

The Website provides general information about ByHaradau, its approach, services and managed digital systems.

The information published on the Website is provided for general business information and does not constitute legal, financial or other professional advice.

ByHaradau may update, remove or change website content when necessary.

4. Using the Website

You may access and use the Website for lawful purposes.

You must not:

• attempt to gain unauthorised access to the Website, server or connected systems;
• introduce malware, harmful code or other disruptive technologies;
• interfere with the operation, security or availability of the Website;
• use automated systems to extract or reproduce substantial parts of the Website without written permission;
• use the Website in a way that violates applicable law or the rights of another person.

ByHaradau may restrict access where misuse, unlawful activity or a security risk is identified.

5. Enquiries and Service Agreements

Submitting an enquiry, requesting a strategic review or communicating with ByHaradau does not create a contract, constitute acceptance of an offer or guarantee that services will be provided. A service relationship begins only when the relevant proposal, order or written agreement has been expressly accepted.

You must provide information that is accurate to the best of your knowledge and must not use our forms to submit spam, automated messages, unlawful material, malicious content or information that infringes another person’s rights. ByHaradau may reject, delete or decline to respond to submissions that are incomplete, misleading, abusive, irrelevant or reasonably suspected to create a security or operational risk.

Any paid services will be governed by separate written documents agreed between ByHaradau and the client. These may include:

• a Managed Website Services Agreement;
• an Order Form or Statement of Work;
• a Data Processing Agreement, where applicable;
• an Acceptable Use and Security Schedule.

Where a signed service agreement conflicts with these Website Terms, the signed service agreement will take priority in relation to the services covered by it.

6. Digital Foundation Check

The Digital Foundation Check provides a limited diagnostic assessment of a website based on information and technical responses that are publicly accessible at the time of the scan.

By submitting a domain or website URL, you confirm that you own, manage or are otherwise authorised to request an assessment of that website. You must not submit a website for an unlawful, abusive or deceptive purpose.

The check may review performance, mobile experience, security configuration, SEO fundamentals, trust signals and structural clarity. It does not attempt to access private areas, obtain credentials, exploit vulnerabilities or conduct penetration testing.

Scores and findings are informational snapshots, not guarantees, certifications or professional security, legal or regulatory advice. Results may be incomplete or affected by third-party services, temporary website conditions, access controls or changes made after the scan.

ByHaradau may refuse, pause or limit a scan where authorisation is unclear, the service is being misused, automated requests are excessive or the assessment could create a security or operational risk.

The free result, any paid report and any monitoring service may have different scopes. Prices, included checks and service terms will be shown before purchase or confirmed separately. Submitting a free check does not create an ongoing paid service.

7. Website Box

Website Box is a one-off digital product that provides a professionally structured website foundation prepared around the requirements stated in your brief. It is separate from ByHaradau’s managed services and does not include ongoing hosting, security, maintenance, monitoring or improvement unless expressly stated in the order.

Before payment, you will be shown or provided with the selected product level, scope, price, delivery format and any material exclusions. Payment is processed through Stripe or another payment provider identified at checkout.

You are responsible for providing accurate information and for ensuring that you have the right to use any names, logos, text, images or other materials supplied to ByHaradau. Delays, incomplete information or requested changes outside the agreed scope may affect delivery and may require a separate quotation.

Delivery takes place after ByHaradau’s verification and is normally provided through a private, time-limited download link. Any stated delivery time is an estimate unless a specific deadline has been expressly agreed in writing.

A Standard Licence permits the delivered Website Box to be used for one website on one domain. An Exclusive Build applies only where it is expressly identified and purchased. ByHaradau retains ownership of its reusable methods, systems, base structures and components; you receive only the licence and deliverables stated in your order.

Compatibility with every hosting environment, plugin, theme or third-party service is not guaranteed. Installation, customisation and technical assistance are included only where expressly stated.

Nothing in these Terms limits your statutory rights. If you are a consumer and ask ByHaradau to begin personalised digital work during an applicable cancellation period, your cancellation rights may be affected only where permitted by law and after any consent or acknowledgement required by law has been obtained.

8. Intellectual Property

Unless otherwise stated, the Website and its content—including its design, structure, text, graphics, branding, visual elements, code and other materials—belong to ByHaradau or are used under licence.

You may view the Website and retain limited extracts for your own internal evaluation of ByHaradau’s services.

You must not copy, reproduce, modify, distribute, publish, sell or commercially exploit website content without prior written permission from ByHaradau.

No ownership or intellectual property rights are transferred to you through your use of the Website.

For Website Box purchases, the client receives the specific licence described in Section 7 and in the applicable order. Reusable methods, systems, base structures and components remain the intellectual property of ByHaradau unless expressly agreed otherwise in writing.

9. Website Availability

ByHaradau takes reasonable measures to maintain the availability, performance and security of the Website.

However, uninterrupted or error-free access cannot be guaranteed. The Website may occasionally be unavailable because of maintenance, technical issues, security measures or circumstances outside ByHaradau’s reasonable control.

ByHaradau may modify, suspend or discontinue any part of the Website when reasonably necessary.

10. Third-Party Services and Links

The Website may contain links to third-party websites, platforms or services.

These third parties operate independently and are responsible for their own content, availability, privacy practices and terms.

A link from the Website does not constitute an endorsement or guarantee by ByHaradau.

11. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation;
• any other liability that cannot legally be excluded.

To the extent permitted by law, ByHaradau is not responsible for indirect or consequential losses arising solely from the use of, or inability to access, the Website or reliance on its general informational content.

Liability connected with paid services is governed by the applicable written service agreement.

Personal information collected through the Website is handled in accordance with the ByHaradau Privacy Policy.

The Website uses cookies and similar technologies as explained in the Cookie Policy.

Changes will apply from the date they are published and will not retrospectively amend an existing signed service agreement.

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes relating to the use of the Website, subject to any mandatory rights that apply under applicable law.
